AlamedaNET Acceptable Use Policy |

Alameda Power & Telecom may modify this Acceptable Use Policy for its Internet
services, AlamedaNET, at any time without prior notification. For this reason, users
should consult the Alameda Power & Telecom website
(http://www.alamedapt.com/alamedanet/acceptable_use.html)
regularly to ensure user compliance with the most recent version of the Acceptable Use
Policy. In the event of any conflict between the Acceptable Use Policy and the Terms and
Conditions of Use, the Acceptable Use Policy will govern.
Alameda Power & Telecom provides a variety of Internet Services (the
"Services") to residences and businesses (the "Customer").
By using the Services you agree to abide by this Acceptable Use Policy as well as any
guidelines, alerts, or rules that may be posted on Alameda Power & Telecom's website
from time to time. You agree that, if any portion of this Acceptable Use Policy is held
invalid or unenforceable, that portion will be construed consistent with applicable law as
nearly as possible, and the remaining portions will remain in full force and effect.

Introduction |
| 1.1 |
This Acceptable Use Policy is designed to foster an online environment of
mutual respect in which everyone is able to enjoy the benefits of Alameda Power &
Telecom services. We believe that the restrictions set out in this Acceptable Use
Policy represent a fair balance between the freedom of the individual and the need for
some basic rules to ensure that Alameda Power & Telecom's Internet access is not
used in an abusive or illegal way. |

Alameda Power & Telecom Internet Customers are responsible for ensuring
that their accounts are used in accordance with this Acceptable Use Policy. If
AlamedaNET has reason to suspect that a Customer, or anyone using a Customer's
account, is violating this Acceptable Use Policy, then the account in question may be
suspended pending an investigation. If, after an investigation, AlamedaNET determines
that an account has been used in violation of this Acceptable Use Policy, AlamedaNET
may, in its discretion, terminate the Customer's account. |

AlamedaNET does not actively monitor its Customer's use of its Services or
exercise any control over the content posted on its Services. We rely on our
Customers to govern themselves and to protect the integrity of the network by
reporting any violations of this Acceptable Use Policy to
cs@alamedanet.net. |

AlamedaNET reserves the right to investigate any violation or alleged
violation of this Acceptable Use Policy, including the right to examine any
information or material on AlamedaNET's servers. |
| 1.5 |
AlamedaNET reserves the right to remove any content that it deems, in its sole
discretion, to be in violation of any part of the Acceptable Use Policy. |
| 1.6 |
AlamedaNET reserves the right to take any steps it deems necessary to prevent
violations of the Acceptable Use Policy from occurring. |
| 1.7 |
AlamedaNET does not assume liability to Customers for any failure to enforce
the terms of the Acceptable Use Policy. The failure of AlamedaNET to enforce this
Policy, for whatever reason, shall not be construed as a waiver of any right to do so
at any time. |
| 1.8 |
AlamedaNET may cooperate with legal authorities and/or third parties in the
investigation of any suspected or alleged crime or civil wrong. |
| 1.9 |
Accounts may be deleted by AlamedaNET when they have been
disconnected for six (6) months or longer. |
| 1.10 |
Full or partial credit of AlamedaNET accounts may be requested in the
event of an outage by sending an email to
cs@alamedanet.net with the dates and times
that your service was affected, and your account will be prorated with credits, if
applicable, showing on the next billing cycle. |
| 2.0 |
Illegal Activities
Customers or anyone using a Customer's account must not use the service to encourage,
facilitate or engage in any illegal activities, including, without limitation:
- defamation: posting or transmitting any material which is
defamatory under any applicable law;
- fraud: posting or transmitting any information that you know or
ought to know is false, and that you intend others to rely on, including making
fraudulent offers to sell or buy products, items or services, or advancing any type of
financial scam such as "pyramid schemes", "Ponzi schemes", and
"chain letters";
- unlawful material: posting or disseminating material which is
unlawful under any applicable law;
- false advertising: posting or transmitting any advertising or
promotional materials that contain false, deceptive or misleading statements, claims
or representations;
- copyright violation: posting or transmitting any information, software,
photograph, video, graphic, music, sound and other material in violation of another
person's copyright. AlamedaNET is registered under the Digital Millennium Copyright
Act of 1998. If you believe that your work has been copied and is accessible on
AlamedaNET in a way that constitutes copyright infringement, you may notify
AlamedaNET.
- trademark violation: posting, transmitting, displaying or
using any words or symbols that violate any other person's rights in its
trademark or trade-name; and
- harm to minors: using the Services to harm, or attempt to harm, minors in any
way, including knowingly soliciting or collecting personal information from a minor
(anyone under 18 years old). Personal information includes without limitation the
name, address, telephone number, or name of the minor's school.

Electronic Mail |
| 3.1 |
AlamedaNET Customer or anyone using a Customer's account must not use
AlamedaNET email to:
- send unsolicited bulk email (so-called "Spam");
- send, or cause to be sent, large volumes of unsolicited email
to a single person or multiple persons or entities (so-called "email
Bombing");
- repeatedly send email to any person or entity who does not wish
to receive it. If a recipient asks to stop receiving email from an AlamedaNET
Customer, then that AlamedaNET Customer must cease sending email to that person;
and
- subscribe to any email list or service on behalf of a third
party without that third party's consent.

AlamedaNET Customer or anyone using a Customer's account must not
engage in any of the activities described in paragraph 3.1 from another provider's e-
mail service and use an AlamedaNET account as an email return address or
"drop" for responses. |
| 3.3 |
AlamedaNET Customer or anyone using a Customer's account must not
forge, alter or remove any email header. |
| 3.4 |
All email addresses at the alamedanet.net domain are property of
AlamedaNET and may be terminated or re-assigned without notice. |
| 4.0 |
Security, Privacy and "Hacking"
The Customer is responsible for any misuse of the Services that originates from his or
her account, even activities committed by any friend, family, co-worker, employee,
guest or anyone with access to the account. Customers must ensure that others not
gain unauthorized access to the Services. |
| 4.1 |
Customer or anyone using a Customer's account, must not:
- disrupt or interfere with the normal operation of AlamedaNET
systems, networks, or activities in any way that adversely affects the ability of
other people or systems to use AlamedaNET Services or the Internet, including,
without limitation:
- denial of service attacks;
- flooding of networks;
- attempts to overload a service; and
- attempts to cause system crashes; or
- use any unauthorized program to connect to any AlamedaNET
Internet Relay Chat (AIRC) server, including, but not limited to, IRC bots or
clonebots; or
- gain access or attempt to gain access to the private systems or
data of AlamedaNET or any third party without the prior consent of AlamedaNET or
the third party.

AlamedaNET Customer or anyone using a Customer's account must not use
AlamedaNET accounts to:
- circumvent or attempt to circumvent security or authentication
systems on any host server, network, hardware, or Customer accounts, including,
but not limited to, logging into any server, account or network without
authorization and electronically probing the security of any system or network;
or
- disrupt or interfere with the normal operation of any system or
network operated by any third party, or attempt to do so; or
- collect or attempt to collect personal information about third
parties without their knowledge or consent.

Usenet Newsgroups
AlamedaNET Customer or anyone using a Customer's account should use his or her best
judgment when posting to any newsgroup. Many groups have charters, published guidelines,
FAQs, or "community standards" describing what is and is not considered
appropriate. |
| 5.1 |
AlamedaNET Customers or anyone using a Customer's account must not:
- post a single article or substantially similar articles to an
excessive number of newsgroups, or cross-post to an excessive number of newsgroups;
- post articles on a newsgroup which are off-topic according to the
newsgroup charter;
- post binary or encoded binary files to newsgroups not specifically
designated for that purpose;
- post commercial messages on a non-commercial AlamedaNET newsgroup
without prior approval from AlamedaNET;
- engage in any of (a), (b), (c) or (d) from a provider other than
AlamedaNET and use an account on AlamedaNET as an email return address or
"drop" for responses;
- engage in any of (a), (b), (c) or (d) from a provider other than
AlamedaNET for the purpose of drawing attention to a service hosted by or on
AlamedaNET's network;
- cancel messages other than their own messages and posts forged in
their name.

AlamedaNET reserves the right to discontinue access to any Usenet
newsgroup and to cancel postings which violate the Acceptable Use Policy at any time and
for any reason. |
| 6.0 |
Censorship and Adult Materials
AlamedaNET believes in freedom of expression and the right of individuals to decide for
themselves what they want to see and listen to. We do not believe it is the place of an
Internet Service Provider to censor or regulate the Internet. However, Customers or
anyone using a Customer's account must not use AlamedaNET to transmit or post any
information or image that is criminally obscene or otherwise prohibited under any
applicable law.
AlamedaNET assumes NO responsibility for Internet content available through the
Services. Customers are responsible for restricting access to sexually explicit material
on the Internet by purchasing the appropriate filtering software or by monitoring Internet
use. Content questions or complaints should be addressed to the content provider.

Miscellaneous |
| 7.1 |
False Pretenses. Customers or anyone using a Customer's account must not
use AlamedaNET to impersonate any person or use a fictitious user name, including in any
email, Usenet posting, or IRC site. This restriction does not preclude the use of
nicknames in IRC, the use of anonymous remailer services, or postings to any site that
permits pseudonyms. |
| 7.2 |
Unsolicited Advertising. Customer or anyone using a Customer's account
must not use AlamedaNET to post or transmit any unsolicited advertising, promotional
materials or other forms of solicitation to any person except in those areas and on those
websites that are designated for such a purpose. |
| 7.3 |
Harassment, Threats and Abuse. Customer or anyone using a Customer's
account must not use AlamedaNET to harass, threaten, or abuse any person or group of
people by any means. Alameda Power & Telecom reserves the right to remove messages or
images that Alameda Power & Telecom in its sole discretion, determines are harassing,
threatening, or abusive. |
| 7.4 |
Crude or Offensive Postings. Customer or anyone using a Customer's
account must not use AlamedaNET to post offensive or crude messages or images on publicly
accessible pages or sites, except where such messages or images are appropriate having
regard to the nature of the site. Alameda Power & Telecom reserves the right to
remove messages or images that Alameda Power & Telecom, in its sole discretion,
determines are offensive. |
| 7.5 |
Multiple access. Customer or anyone using a Customer's account must not
maintain more than one simultaneous connection to AlamedaNET or any AlamedaNET service,
IRC group or newsgroup. Alameda Power & Telecom reserves the right to terminate any
Customer's connection following any extended periods of inactivity as determined by
AlamedaNET. |
| 7.6 |
Disruptive Conduct. Customer or anyone using a Customer's account must
not use AlamedaNET to disrupt the normal flow of online dialogue, or otherwise act in a
manner that negatively affects other users, individuals or entities. |
| 8.0 |
Bandwidth/Network Traffic and Other Limitations
Customers must comply with the current bandwidth/network traffic, data storage and other
limitations on the Services.
The Customer must ensure that his or her account activity does not improperly restrict, inhibit or degrade any other customer's
use of the Services, nor represent, in the sole judgment of Alameda Power & Telecom,
an unusually large burden on the network itself.
The calculation used to determine the actual bandwidth/network traffic allocation is based on a bandwidth factor for
the account category and the maximum download speed for the specific account.
Residential accounts use a bandwidth factor of 30, and Business accounts use a bandwidth factor of 45.
The following is an example of the calculation used to compute the maximum traffic allocation included with a
residential AlamedaNET account offering 3Mbps as its maximum download speed:

The bandwidth/network traffic allocation will be compared against the customer's end of month total download or
total upload data traffic over the network, whichever is higher.
Customers exceeding the bandwidth/network traffic allocation amount specified for their Service Package may be charged
$1.00 for each Gigabyte used in excess of their specified allocation.
In addition, Customers must ensure that their activity does not improperly restrict, disrupt, inhibit, degrade or
impede Alameda Power & Telecom's ability to deliver the Services and monitor the Services, backbone,
network nodes, and/or other network services.
Customers may not resell, share, or otherwise distribute the Services or any portion
thereof to any third party without the written consent of Alameda Power & Telecom.
For example, Customers must not provide Internet access to others through a dial up
connection, host shell accounts over the Internet, provide email or news services, or
send a news feed, unless express permission is granted by the Customer Agreement.
AlamedaNET Residential Services are not intended for business applications such as
serving streaming video or audio, mail, http, ftp, irc, dhcp servers, and multi-user
interactive forums. You may not provide network services to others via AlamedaNET.
