Commercial Cable Television Service

Applicability

This schedule is applicable to cable television service for commercial customers where no television service agreement exists and where usable cable lines exist along Alameda Power & Telecom's (Alameda P&T's) cable television distribution system.

Service is supplied to the following commercial customer groups:

• Group A: Commercial Establishments

  for cable television service to commercial establishments, except for restaurants, bars, taverns, hotels, motels, hospitals, nursing homes or extended stay facilities.

• Group B: Restaurants, Bars and Taverns

  for service to establishments where food and/or beverages are sold and cable television service is desired primarily for viewing by customers or the public.

• Group C: Hotels, Motels, Hospitals, and Nursing Homes

  for service to establishments where cable television service will be offered to guests, customers, or patients in temporary lodging or extended stay/care facilities.

Rates

Premium Services (Available to Group C customers only)

Premium Services are available to Group C commercial customers for an additional monthly charge. The prices below are for each individual room or television set where Premium Service is desired. A separate converter and remote control is required for each room or television set where the Premium Service is to be aired (see Section IV, Equipment Rental, for rates). Premium Services may not be aired in public areas.

Equipment Rental

Negotiated Bulk Service Agreements

For cable television service to Group C commercial customers, Alameda P&T may negotiate bulk service agreements at discounted rates. Discounts will be based on the number of units, the average occupancy rate, the total capital cost born by Alameda P&T, and the length of the bulk service contract.

Per Public Utilities Board Resolution No. 4507 (8/29/2001), such discounts will comply with the following guidelines:

• Price discounts:
  Between 1 and 40% off the Basic and Expanded Basic rates
• Volume Discounts:
  Minimum of 8 services
• Term:
  Two to seven years
• Minimum Revenue:
  $350/service net revenue per year of the term of the agreement

Bulk Service Agreements are not available to Group A or Group B commercial customers.

Franchise Fee

To the preceding charges will be added a Franchise Fee (refer to Rider FF).

Public, Educational and Government Access Fee

Each separate customer account will be charged a Public, Educational and Government Access Fee (refer to Rider PEG).

Local Taxes

To the preceding charges, exclusive of the Franchise Fee and Public, Educational and Government Access Fee, will be added any applicable local taxes (refer to Rider UUT).

Definitions and Special Conditions

1. BASIC CABLE SERVICE
   Primary level or levels of cable service offered for subscription. Basic Cable Service offerings may include retransmitted broadcast signals as well as local access programming. In addition, regional and national cable networks programming may be provided.
2. EXPANDED BASIC CABLE SERVICE
   Level of service that generally carries all non-premium cable channels. Expanded Basic Cable Service is an optional level of service above and beyond Basic Cable Service and is billed separately from Basic Cable Service. A customer must receive Basic Cable Service in order to be eligible to receive Expanded Basic Cable Service.
3. PREMIUM SERVICES
   Individual channels that offer special programming for an additional monthly subscription fee, such as HBO, Cinemax, etc.
4. DIGITAL CABLE SERVICE AND PAY-PER-VIEW
   Digital CATV Service and Pay-Per-View Service are not available to commercial customers.
5. CHANNEL LINEUP
   See current Channel Lineup for a list of channels offered for Basic and Expanded Basic services.
6. DISCOUNTS AND PROMOTIONS
   At the direction of the General Manager and subject to summary reporting to the Public Utilities Board, Alameda P&T may utilize discounts and/or promotions to enhance customer acquisition strategies. These promotions may include the waiver of charges, offers for free service for a limited period of time, and other tactics that it deems appropriate.

   Other conditions, as specified in Alameda P&T's Rules and Regulations, shall apply to this rate schedule.
